PONTIANAK KALBAR – Pengamat Hukum dan Kebijakan Publik Kalimantan Barat, Dr. Herman Hofi Munawar, memberikan tanggapan terkait hebohnya pemberitaan mengenai seorang pasien yang diduga mengalami patah tangan dan mengeluhkan pelayanan lamban oleh petugas di salah satu rumah sakit di Pontianak.(29/6).
“Rumah sakit hendaknya memberikan sanksi tegas terhadap tenaga medis yang lalai dalam memberikan pelayanan terhadap pasien. Sanksi tersebut sebagai upaya dalam peningkatan mutu pelayanan kesehatan di rumah sakit,” ungkap Dr. Herman pada Sabtu, 29 Juni 2024.
Menurut Dr. Herman, perilaku tenaga medis mencerminkan kualitas manajemen dan kepemimpinan rumah sakit itu sendiri. Pelayanan yang buruk mengindikasikan manajemen yang tidak efektif dan kepemimpinan yang lemah. “Pemimpin rumah sakit harus mampu menggerakkan semua komponen untuk mewujudkan visi rumah sakit,” tambahnya.
Rumah sakit, lanjutnya, merupakan instrumen penting dalam mengatasi masalah kesehatan masyarakat dan memiliki tanggung jawab konstitusional untuk menjaga kesehatan warga negara. Di dalam rumah sakit, tenaga kesehatan dengan berbagai keahlian bertanggung jawab penuh atas segala peristiwa yang terjadi, termasuk kelalaian dalam pelayanan medis.
“Tanggung jawab tenaga medis ini diatur dalam Pasal 1366 dan 1367 KUHPerdata, serta lebih spesifik dalam UU No. 44 Tahun 2009 tentang Rumah Sakit. Pasal 46 menegaskan bahwa rumah sakit bertanggung jawab secara hukum atas semua kerugian yang ditimbulkan akibat kelalaian tenaga kesehatan,” tegas Dr. Herman.
Pasal tersebut menerapkan asas corporate liability, yang mengharuskan rumah sakit untuk selalu mengawasi tindakan tenaga medis agar tidak terjadi kelalaian yang merugikan pasien. Jika terjadi kerugian, pasien atau keluarga pasien dapat menempuh upaya hukum baik melalui litigasi maupun nonlitigasi, dengan mediasi sebagai alternatif penyelesaian yang bijaksana.
“UU No. 36 Tahun 2009 tentang Kesehatan pada Pasal 29 menegaskan bahwa kelalaian tenaga kesehatan harus diselesaikan terlebih dahulu melalui mediasi,” jelas Dr. Herman. Namun, keputusan tetap ada di tangan pasien atau keluarga pasien untuk memilih cara penyelesaian yang diinginkan.
Dr. Herman menekankan bahwa rumah sakit sebagai sarana pelayanan kesehatan harus memberikan pelayanan yang paripurna dan menyeluruh kepada masyarakat, sesuai dengan Pasal 4 UU No. 44 Tahun 2009. “Apabila terjadi penyimpangan atau kelalaian, rumah sakit harus bertanggung jawab penuh dan memberikan sanksi tegas sebagai bentuk peningkatan mutu pelayanan,” ujarnya.
Pasien yang menjadi korban kelalaian memiliki hak untuk menuntut pertanggungjawaban tenaga medis dan meminta perlindungan hukum. “Hal ini penting agar tenaga medis tidak lari dari tanggung jawab atas perbuatannya,” pungkas Dr. Herman Hofi Munawar.
Dengan tegaknya Pasal 46 UU No. 44 Tahun 2009, diharapkan rumah sakit di Pontianak dan seluruh Indonesia dapat meningkatkan kualitas pelayanan medis, memberikan rasa aman dan kepercayaan kepada masyarakat, serta memastikan bahwa kelalaian medis tidak terulang kembali.
